Emergency Supply Caches Available to Berkeley Neighborhoods

Neighborhood and community organizations who are prepared to be self-sufficient in a major disaster can now apply to get free containers stocked with emergency response equipment from the City of Berkeley.

The Office of Emergency Services now has applications available for the 2012 Community Emergency Supply Program application. Measure GG passed in November of 2008 provided funding for a limited number of emergency supply caches to be awarded to neighborhoods or community organizations that show a high degree of preparedness and organization. The Community Emergency Supply Program has been supporting neighborhood organizations with supplies and training since 2003. There are currently 62 City-awarded disaster equipment caches distributed throughout the city.

It is essential that every household, family, apartment tenant, neighborhood and community group be prepared to survive for five to seven days on their own, until utilities and services can be restored. The disaster cache program aims to foster awareness and provides neighborhoods and community organizations a goal for a minimum level of readiness to attain. No one is prepared until everyone is prepared.

The equipment that includes portable generators, fire suppression hoses and nozzles, disaster first aid kit, portable communication radios and other safety equipment.

Caches will be awarded based on several criteria, including geographical distribution across the City, the risk assessment of the neighborhood, and the level of neighborhood involvement in the Community Emergency Response Training program.

The 2012 Community Emergency Supply Program is accepting applications through May 25, 2012. Applications can be picked up at the Fire Department Administrative Offices at 2100 Martin Luther King Jr. Way, 2nd Floor, Monday-Friday, 8 a.m. - 5 p.m., or online on the Office of Emergency Services web page at http://www.ci.berkeley.ca.us/WorkArea/linkit.aspx?LinkIdentifier=id&ItemID=3920.

Foreclosure review under way
The Office of the Comptroller of the Currency (OCC) and the Federal Reserve Board announced Tuesday that the independent foreclosure reviews of 14 large servicers issued in April now are underway.
Approximately 4.5 million borrowers could have their loans reviewed and potentially be compensated for imposed financial hardship, according to a previous statement by the OCC.
According to the OCC, the review will take several months due to the volume of potential foreclosures to review.
The foreclosure review is part of a broader list of enforcement actions for the servicers to rectify missteps in the foreclosure process. The enforcement actions mandated by the OCC include improved borrower communications, greater oversight of third-party vendors, updated management information systems, and the elimination of “dual tracking” – which takes place when a servicer forecloses while a borrower is being considered for a modification.
Borrowers wishing for review may visit IndependentForeclosureReview.com, or call 1-888-952-9105 Monday through Friday between 8 a.m. and 10 p.m. Requests for reviews will be accepted through the end of April.

Rabid Bat in Berkeley

Did you know that Alameda COunty is a declared "Rabies Area" and has been since 1958? The material below was taken from the City of Berkeley Website and is a reminder to all to be careful around wild animals, living or dead.

INFECTED BAT A REMINDER TO USE CAUTION

Berkeley, California (Thursday, October 20, 2011) - A bat infected with rabies was recently found in the area of the 300 block of Rugby Avenue in the City of Berkeley. Although the bat was removed without incident, residents in Berkeley and the surrounding areas are advised that Alameda County has been a “Rabies Area” since 1958.
In Berkeley, bats and skunks are the most likely animals to be infected, although unimmunized dogs, foxes, coyotes, badgers, weasels, raccoons and unvaccinated cats can also carry the rabies virus.
Rabies infection is virtually always fatal in man so it is critical that people know how to prevent infection. Avoid skunks and bats and do not handle dead wild animals.
Educate your children about the dangers of wild animals and warn them not to touch any animal they do not know.
Any nocturnal animal which is seen during daylight hours such as skunks, bats, or grey foxes should be considered dangerous.

Call Berkeley Animal Control Services at (510) 981-6600, Monday-Sunday, 8:00 a.m. - 4:00 p.m., if suspicious or dead animals are observed in your area. For after-hours emergencies contact Dispatch at (510) 981-5900.

RABIES FACTS AND PROTECTIVE MEASURES

• Rabies is found in most counties in California including Alameda County. Alameda County has been declared a "Rabies Area" since 1958.
• Rabies is a deadly virus disease which affects the nervous system. Once symptoms start in an infected human being it is uniformly fatal. There is no known cure.
• Rabies is transmitted in the saliva of infected warm blooded animals (mammals) through mucous membranes or any break in the skin by biting, licking or scratching.
• Animals at high risk for carrying rabies are skunks, bats, dogs which have not been vaccinated against rabies, foxes, coyotes, badgers, weasels, raccoons, and wild and unvaccinated domestic cats. Rodents (gophers, mice, hamsters, squirrels, rats, opossums, guinea pigs) and rabbits are considered very low risk for rabies.
• The degree of risk to humans and pets for rabies is determined by the species of the animal and the circumstances. There is no risk for rabies from reptiles, birds, or insects.
• If a wild animal such as a skunk, bat, or grey fox which is normally nocturnal (active at night) is seen in the daylight acting in a strange manner, it may be tested for rabies by the State Health Laboratory. Example of animals to be tested:

A skunk roaming or staggering in daylight.
A bat hanging on a window screen or sill.
A grey fox acting in an aggressive manner in the daytime.

• Immediately call the City of Berkeley Animal Control Services at (510) 981-6600 regarding strange acting animals.
• The following are protective measures that are necessary to prevent rabies in humans and domestic animals.

Have dog(s) and cat(s) vaccinated against rabies. Vaccination and Licensing is required for all dogs 4 months of age and older. Dogs which are first vaccinated at one year of age or less must be revaccinated one year later. The interval for revaccination is three (3) years for older dogs.
Confine dogs to property especially puppies less than four (4) months of age since they are not protected against rabies. Otherwise, if a dog is taken off the premises it must be on a leash.
Report any animal bites of humans or any close contact between dogs or cats with skunks or bats or other wild animals to the City of Berkeley Animal Control Services at (510) 981-6600.
Avoid wild animals or domestic animals which are strays or which run loose. Do not feed wild animals by hand. It is dangerous to attempt to feed, pet, or care for sick or injured animals.
Do not attract skunks or raccoons with food! They will eat garbage, fruit, vegetables, and especially dog and cat food. Pet food left outside is a strong invitation to wildlife. Keep garbage cans covered with tight fitting lids.
Do not provide shelter for skunks and other wild animals. Close all openings under your home and other buildings. Keep foundation vent screens in good repair. Eliminated piles of trash, rocks, wood, hollow logs, heavy growth of vegetation and other possible hiding places.
Do not provide shelter for bats. Close, seal, or screen all openings so there is none greater than 1/4" in size especially at roof level. Install 1/4" screen on attic vents and maintain in good repair.

Berekely has beguna program where they will put a "boot" on your car, making it impossible to drive off, if you are one of the "scofflaws." Apparently right now there are over 1.5 million dollars worth of unpaid parking tickets and these funds would benefit the city budget. This program is scheduled to begiin in about 2 weeks!

Two Big Choices Facing Most Home Buyers

Unless you have unlimited resources there are two distinct choices you will be facing when buying a home. These choices are , in most cases never really articulated. Most home buyers eventually arrive at this realization but coming to it sooner will save a great deal of time and frustration.

A group of us at Red Oak Realty were discussing recently ways that we could help our clients in the home buying process. One of the things we talked about were the decisions facing home buyers as they move through the process. Of these decisions perhaps the two biggest are as follows.
TIME/ MONEY
and
LOCATION/ CONDITION
Most of us will have to choose one from each group. This is a forced choice. Which in each group is more important? Choose either Time or Money. Then choose Location or Condition.

Lets look at the first choice. We have a budget. We can save money by buying a short sale, fixer or REO (bank owned foreclosure), but these take more time. Or we can save time by purchasing a conventional sale in a home that is remodeled and move in ready. There are lots of variations to this equation. But the idea is simple: Choose which is more important.

The second choice is not as obvious to most buyers. Lets face it, how many times in our lives do we buy a home? If location is most important to you then you will notice that the 'desirable' locations tend to be more expensive so you end up getting less house for your money. Whereas you may be able to get everything you want in a house in a less desirable neighborhood. Somewhere on this continuum the right home awaits you.

I recommend that the Home Buyer includes these decisions in their home buying strategy. Sit down with your realtor and use these to come up with a plan that quickly focuses your home search and brings you to the home that most closely matches your needs.

We're Back to Normal!

Good news for the housing market!! The number of NEW foreclosures and notices of default has returned to normal. What this means is that we are well on the way to a normal housing market. Picture a python who can eat a pig whole. That pig works its way through the python's digestive system until it is completely digested. This analogy applies to foreclosures and notices of default. The system had to digest an extraordinary amount of them. This lump is working its way through the system and when finished we're back to normal This information should be of particular interest to buyers who want to purchase at the best time. Oakland Art Murmur is a group of nearly 20 galleries in Oakland that have coordinated openings Wander from gallery to gallery, sample free nibbles, drink some free wine, see occasional outdoor movies and fine some new artists to love at venues like 21 Grand, Blank Space, Luka’s Taproom, Rowan Morrison, Rock Paper Scissors Collective and more.

Every First Friday of the month, member galleries are open to the public from 6-9 pm. Additionally 23rd Street between Telegraph and Valley is closed to car traffic, and craft, art, and food vendors are set up along this corridor.

Getting There:
Member galleries are generally located between 22nd and 26th Street and along the Broadway/Telegraph corridors. You may view the map for more specific locations. To get to the area using BART, get off at the 19th Street Oakland stop, which is only a few blocks away. The 12 (Grand St), 51A (Broadway), and 1(Telegraph) AC TRANSIT buses also come right to the Uptown District.

COMMUNITY STAGE features performances directed towards novice entertainers. Auditions are held 60 days prior to the Festival. HEALTH FAIR- Alameda County health agencies offer informational workshops and health screenings. TWO ON TWO BASKETBALL TOURNEY provides wholesome, physical competition on event day. HISTORICAL EXHIBITS includes an indoor exhibit hall featuring a collaboration of presenters. ART FOR CHILDREN programs and for-fun activities are coordinated by practicing artists. The VISION MAGAZINE is a BJF souvenir publication sold on Festival day which features the day's activities.

4th of July @ Berkeley Marina

The 4th of July is a great day to have a lot of fun. The biggest party is at the Berkeley Marina from noon-10PM. There's all kinds of free fun! Adventure Playground, always a favorite, is open 11am-8pm. Get your face painted, try the giant slide, or splash in the water at the beach!

There's live entertainment from noon until 9:30PM on the main stage including Downtown Rhythm, Lee Waterman & Jazz Caliente, The Hipwader's Children's Music, Tin Sandwich Harmonica Trio, The Ian Franklin Band, Foxtails Brigaide, & Steel Pans. Tucked around the marina are Afro Cuban Rumba Drumming, Circus Art performers, and on The Buddy Club Stage in Shorebird Park you'll find jugglers and magicians. There's art & crafts, yummy food, massages, free dragon boat rowing from 2-6pm, pony rides, a dunk tank, and much more including the grand fireworks off the end of the Berkeley Pier at 9:30pm.

Let's hear it for the red, white, and blue...but keep it green, too. The party shouldn't leave the environment trashed. If you can, bring your own dishes -- Frisbees double as plates! A bandana is your cloth napkin to use at all of the international food booths. With water stations located around the event, you can refill your own reusable bottle and keep a lot of plastic out of the landfill. Be sure to use the recycling stations located throughout the marina for your disposables.

Getting There:
CARS: There is plenty of free parking in the Marina, noon-11PM. However, the roads close 7-10:30PM (and the Police have the option to close them earlier if the lots are 100% full) so you can't get in or out between those hours. Come in earlier! After the fireworks, and after all of the pedestrians have left the Marina, the road opens to vehicles (around 10:30PM) when you may drive out.
BUS: AC Transit runs on a slow 51B Sunday schedule from Downtown Berkeley BART right into the Marina. At the end of the event, however, you have to walk, with the rest of the crowd, out to 6th and University Ave. near Spenger's to pick up a bus back to BART. Unfortunately, we do not have an event shuttles.
BICYCLES: Free valet bicycle parking. Ride your bicycle over the Berkeley overpass and Richmond Spokes will valet park it for you in the lot near Adventure Playground from noon-10PM. But be sure to pick it up by then!
Dogs are OK on a leash.

Inspired by plant swaps around the San Francisco bay area, Dan and I have decided to bring this FREE sharing event to North Oakland. Located in the Golden Gate neighborhood we host plant swaps twice a year: once in spring and once in fall.

At the plant swap you can bring: unwanted plants, cuttings, seedlings, starts, foraged plants, and seeds.

This is also a great place to bring any extra pots, natural fertilizers, vermicompost/worms, garden tools, etc you have and are no longer using. Pass them all on to a new home and come pick up some new-to-you plants for your garden and home.

The only entrance fee is something brought to add to the swap.

We wrote our offer on a Richmond Annex property on January 29th. A week later we were in contract. By the end of the following week we had completed all our inspections and based upon these inspections requested a price reduction to help cover the cost of repairs needed.

The listing agent advised us that this request would not be accepted and a week later she was proven right. My clients were not willing to proceed based upon the initial price and the inspections. So we sent in a request for a price reduction of a lesser amount. A week later this was accepted and we're ready to move forward. By this time we're a month into the negotiations. We got our appraisal done and everything is flowing the way it should. All the bumpy spots are now out of the way, or so we thought.

On Monday, March 14th, we signed loan docs, had a glass of champagne and looked forward to closing. Final loan conditions were met and buyers wired remainder of downpayment to Escrow holder on Thursday, March 16. Now we're done. All we have to do is sit back and wait for the loan to fund and the deed to be recorded. Not so fast.

Thursday evening I received a phone call from the listing agent. "Hello Bill. I have some bad news for you..." She want on to explain that she didn't have the details but needed to inform me that the bank was cancelling the contract and that the appropriate docs would be drawn up and sent to us on Friday. It seems that the bank believes that it may not be the legal owner of the property! It may have not followed the correct procedures for foreclosure and therefore cannot legally sell the house and needs foreclose all over again!

One might wonder what the bank would do if they were a day later and the property had closed. Or for that matter what my clients would have done, if the bank sold them a property that wasn't theirs to sell. I wonder how many of these have already been sold.

My clients are now almost two months into this transaction, emotionally tied in to it, financially have spent on inspections, appraisals, well over $1500.

I'm feeling an emotional charge about this one. My clients are great. They've never bought a home before and shouldn't be treated this way.

Do my clients have a recourse? Unlikely. The Bank's addendum to the purchase contract makes it very clear that there is no recourse.

One wonders if the banks (yes I'm lumping them all together) have any kind of conscience at all. First they create a crisis in the housing market (See the movie Inside Job, or listen to the director tonight on KQED 8PM or 3/19 at 2PM--Commonwealth Club), then they foreclose, then in the rush to make a buck don't even do it correctly. I wonder if any of us will even get a letter of apology. I'm not expecting it.

The current charts graph the past 24 months and give a very good picture of market trends, highs and lows, etc.

Mortgage Rates Up or Down?

Mortgage rates took a large hike yesterday and have come down a bit today. It is important to keep an eye on rates becasue they will tend to respond to economic news. In general good news makes higher rates. Higher rates make houses more expensive to buy because even though the price of the house may not rise, because most of us need a mortgage, when rates rise our buying power declines.

For those who are waiting for the market to bottom out my opinion is that you are already too late. Rates are going up and home prices are unlikely to decline a whole lot more. I think there will be a rush of buyers this spring as the public begins to figure out that they miss the boat entirely as rates go up...which they will. You can take that opinion to the bank!

East Bay Sewer lateral ordinance update

Many East Bay Communities already have a point of sale ordinance that requires inspection and in many cases replacement of the sewer lateral when the property is sold. Berkeley, Richmond, Albany, El Cerrito, Kensington already have these ordinances. EBMUD is the latest to join in. Two of the communities affected will be Oakland, Emeryville. The Original start date for the ordinance was for properties that went into escrow starting January 2011.
Per a discussion with EBMUD that is no longer the established start date.
A new date will be determined by the end of December.

This is comparative data that shows month by month for the past 2 years what the market activity was. You can see trends, highs and lows. Take particular note for Median Price, days on market and months supply of inventory. Its pretty clear from this data that even though we're having a dip in prices and sales activity in many areas currently, the bottom of the market hit most areas in 2009, typically in the spring, and it will take quite a drop to match these lows. This link (click here) will take you to the city of Berkeley to give an example of the charts. there are 21 pages posted for each area so look at them carefully. If you are buying a home or selling a homee you wiall want to look at this market data. I have select zip codes posted as well if you want a more acurate picture of your area. Home ownership getting harder

Mortgage Rates Climbed Again 11/15/2010

Mortgage Rates climbed again, as retail sales figures came in much higher than expected. Keep in mind that signs of an improving economy usually send rates upward, as a strong economy could trigger inflation and Fed "tightening" (rate increases). Retail sales figures are very important because our economy is so driven by consumer spending, and retail sales are a great indicator of consumer spending. Rates today are hovering around 4.25% with one point.

I want to point out that the election is over and my prediction that rates would stay low until that time was accurate. Now, with signs of an improving economy its only a matter of time before they go up. There will not be a better time to purchase a house than now!

What I'm listing below is not necessarily the gospel truth. I haven't been able to get an exact formula and the more people you talk to the more you'll get different answers to the above question, "How do mortgage lates, short sales, foreclosures, and bankruptcies affect your credit?"

Mortgage Late Payments

Credit score can drop from 100-180 points
other credit interest rates could be affected (credit cards, equity lines)
No new mortgage for 12-24 months depending on circumstances

Short Sales

Credit score can drop from 180-250 points
Other credit interest rates could be affected
No new mortgage for a minimum of 2 years depending on circumstances

Foreclosure

Credit score can drop from 180-250 ppoints
Other credit interest rates could be affected
No new mortgage for 3-7 years depending on circumstances
Will need minimum of 680 credit score and 10% down on next purchase

Bankruptcy

Credit score can drop 200-300 points
Other credit interest rates could be affected.
No new mortgage for 2-4 years depending on circumstance and type of bankruptsy

The Central and South Berkeley Real Estate Report, October, 2010

We are solidly into the 2nd half of the home buying/selling season. And from all accounts it appears to be anything but robust. If you are looking to purchase a home or investment property in South or Central Berkeley there may never be a better time. We know that interest rates are low and will stay that way at least until the elections in November. And inventory is higher than it has been for quite a while. And most importantly, there are fewer committed buyers out there right now. (I think most buyers are not sensing any kind of urgency.) These three facts represent a strong buyers market, perhaps for the first time in South and Central Berkeley.

Our area has shown tremendous resilience throughout this economic downturn. Nevertheless, expect prices to drop a bit even more as we enter the fourth quarter. Remember you heard it here first.

Every once in a while I post something that is not related to Real Estate or living in the East Bay. This is one of those times. So if you just want real estate, or neighborhood information about Berkeley, Oakland, Emeryville or other East Bay communities this particular post is not the one for you.

This article should be read by everyone who uses the Internet. We're always hearing about how "private info got leaked on FaceBook or some other website. but most of us are not aware that profiles of our online behavior are being created while we surf the web. The article below addresses this and gives strategies for keeping our online selves private. Much thanks to Jennifer Valentino-Devries for the article.

How to Avoid the Prying Eyes

Visitors to almost every major website are tracked online, a Journal investigation has found. But there are ways to limit the snooping.
Step by Step
Almost every major website you visit is tracking your online activity. Here's a step-by-step guide to fending off trackers.
Web browsing activity is tracked by use of "cookies," "beacons" and "Flash cookies," small computer files or software programs installed on a user's computer by the Web pages that are visited. Some are useful. But a subset ("third party" cookies and beacons) are used by companies to track users from site to site and build a database of their online activities.
Simple Steps
Major browsers including Microsoft Corp.'s Internet Explorer, Mozilla Foundation's Firefox, Google Inc.'s Chrome and Apple Inc.'s Safari, have privacy features. To have the most privacy options, upgrade to the latest version of the browser you use.
Check and delete cookies: All popular browsers let users view and delete cookies installed on their computer. Methods vary by browser.

For instance on Internet Explorer 8 (the most widely used browser), go to the "Tools" menu, pull down to "Internet Options" and under the "General" tab there are options for deleting some or all cookies. There might be hundreds, so deleting all might be easiest. But the next time you visit a favorite site, you may need to retype passwords or other login data previously stored automatically by one of those cookies.

Adjust Browser Settings: Once you've deleted cookies, you can limit the installation of new ones. Major browsers let you accept some cookies and block others. To maintain logins and settings for sites you visit regularly, but limit tracking, block "third-party" cookies. Safari automatically does this; other browsers must be set manually.
There are downsides to blocking all cookies. If you frequent sites that require logins, you will have to log in each time you visit.

WSJ's Jennifer Valentino-DeVries offers some advice on how to avoid prying eyes online. Plus, consumer spending data released Tuesday shows that Americans are spending more on electronics like iPads and flatscreen TVs. WSJ's Emmeline Zhao joins Simon Constable on Digits to talk about why Americans love electronics.
Internet Explorer lets you set rules for blocking cookies based on the policies of the cookie-placer. One option blocks cookies that don't include a privacy policy; another blocks cookies that can save your contact information without your approval. The control is under "Tools/Internet Options/Privacy."
No major browsers let you track or block beacons without installing extra software known as "plug-ins," as described under advanced steps.
Turn On "Private" Browsing: All major browsers offer a "private browsing" mode to limit cookies. Chrome calls it "Incognito." Internet Explorer calls it "InPrivate Browsing," but this option is available only in the latest version, IE8.
Private browsing doesn't block cookies. It deletes cookies each time you close the browser or turn off private browsing, effectively hiding your history.
Private browsing isn't selective. It deletes all cookies, whether useful or not. So you might want to use private browsing selectively, such as when looking at health-related information.
Monitor "Flash Cookies": Another kind of cookie uses Adobe Systems Inc.'s popular Flash program to save information on your computer. Flash is the most common way to show video online. As with regular cookies, Flash cookies can be useful for remembering preferences, such as volume settings for videos. But marketers also can use Flash cookies to track what you do online.
To identify the Flash cookies on your computer and adjust your settings, you need to go to an Adobe website: www.macromedia.com/support/documentation/en/flashplayer/help/settings_manager.html. You can delete Flash cookies stored on your computer and specify whether you want to accept future third-party Flash cookies.
The downside of blocking third-party Flash cookies: Some sites won't let you watch videos or other content.
Advanced Steps
Install Privacy "Plug-ins": Small programs called "add-ons" or "plug-ins" can help maintain privacy. Some let you monitor trackers that can't be seen through the browser; others allow you to delete cookies on a regular schedule.
Not all browsers can use all plug-ins. And some plug-ins can be tricky to set up. With those caveats, some plug-ins may be worth a look:
Abine: Developed by a Cambridge, Mass., start-up of the same name, it attempts to control several types of trackers. Once installed, the program will warn you when a site is placing cookies or Flash cookies on your machine. You can also see and block a third type of tracker called a Web "beacon" (sometimes called a "bug"). This is an invisible object embedded in a page that can interact with cookies. It's available only in "test" versions, so this is only for people who don't mind experimenting a bit with software. For Firefox, go to addons.mozilla.org/en-US/firefox/addon/11073/. For Internet Explorer, users need to request an invitation at getabine.com.
Better Privacy: This plug-in offers control over Flash cookies. It doesn't block them, but lets you set rules for deleting them—a distinction that can be helpful if you frequent sites that require you to use third-party Flash cookies to see their content. Better Privacy (available only for Firefox) is at addons.mozilla.org/en-US/firefox/addon/6623/.
Ghostery: Available at ghostery.com, it helps control beacons. It alerts you when there's a beacon on a page you're viewing, tells you who placed it and details the company's privacy policy. With Internet Explorer or Firefox, you can then block the beacon from capturing information on your computer. That feature isn't available for Chrome.
Controlling Ads
Users troubled by targeted advertising can block or limit the ads being shown. Note: These tools don't necessarily restrict tracking. Some ad networks may still collect data on your browsing behavior and share it with others, even if you instruct them not to show you targeted ads.
The Network Advertising Initiative, an industry group of marketing companies, lets computer users opt out of targeted ads from about 50 ad networks at networkadvertising.org.
If you opt out, you won't be shown ads tied to your browsing behavior from the member networks. But you'll still see ads, which may be placed based on criteria such as your location.
PrivacyChoice LLC, an independent group, maintains a Web site (privacychoice.org/choose) that covers 152 ad networks. You can opt out of most by clicking a button there. For some, you'll need to download a plug-in, but it works only with Firefox.
Ironically, these opt-out systems work by installing a cookie on your computer. That cookie tells ad networks to stop sending targeted ads to your computer. Because these systems rely on a cookie to work, you'll need to opt out all over again any time you delete cookies from your machine.

New Short Sale Bill signed into law by Governor Schwarzenegger

I want to let you know that Gov. Schwarzenegger just signed the attached bill into law, which prohibits deficiency judgments on first deed of trust on residential property (4 units or less), where the property is sold through a short sale.

The law hasn't allowed deficiency judgments on foreclosure sales (ie., lender can't recover from the borrower the difference between the amount owing on the loan and the amount the lender recovered from selling the property) since the 1930s, but that wasn't the case with short sales (unless the borrowers negotiated a deal otherwise with the lender) until now. With this new law, a lender cannot recover a deficiency judgment following a short sale. However, this protection only applies to natural persons (individuals, not corporations), and only applies on first trust deeds.

Gas Line in Berkeley CA.

I've been getting some requests for finding a map that shows the gas lines in Berkeley. So far, this is what I've been able to come up with. It appears that there is a hazardous gas line that runs along the Pacific Union Rail Road right of way along Aquatic Park. The PG&E natural gas line appears to run down 7th street/6th street. Buying a Foreclosure (foreclosed home) in Berkeley Ca.

There are basically three different ways to buy foreclosed properties in Berkeley, Oakland or really anywhere for that matter. There is the Trustee Sale. This is the actual foreclosure sale. It usually takes place on the courthouse steps and at this sale there is an opening bid and an auction. These are not for the faint of heart. Usually you are bidding against investors who do this for a living. You are not afforded the same kind of protection that you get in a more normal sale that has an escrow process. At the steps you bring your money and you buy as -is. If there are clouds on the title...they are now yours. If there are problems with the foundation they are now yours. If there are uncooperative tenants, they are now yours, etc. Even the pros get burned from time to time. So, if you want to do this please go a few times and see how its done. Research the property you are interested in, do a title search etc. Go prepared.

There are also preforeclosure sales. These are typically Short Sales. Where a homeowner is carrying a mortgage for more than the property is worth. In order to sell the home the owner is required to pay off the mortgage at the close of escrow which means bringing in a large sum of money not covered by the sale. So the owner needs permission from his lender to come in short. The lender is then expected to eat the loss which in many cases is cheaper and quicker than going through the foreclosure process. These properties are often a bargain but you pay for them in the length of time it takes to complete them. If you are willing to wait and take the chance that the lender may not approve the sale this is a great way to buy a a home at a discount.

There are also post foreclosures. These are known as REOs (Real Estate Owned) which refers to how banks name these products. These are the homes that are not bought at the Trustee Sale on the courthouse steps and are now part of the bank's portfolio. They are often but not always run down and lack curb appeal as they are usually listed as-is. Sometimes a good cleaning and a coat of paint makes them very happy. Again these are often baragin properties.

In my practice I work with Short Sales (buyers and sellers) ( Click here to perform a short sales search) and REO's (buyers only) (Click Here to do a search of available REOs) throughout the East Bay but primarily closer in, in communities such as Berkeley, Oakland, El Cerrito, Albany etc. but I stay away from the courthouse steps. In Defense of Home Ownership

Of course you would expect a realtor to be in favor of home ownership. Afterall, if nobody bought homes any more we'd only have landlords for clients! A brief overview of world cultures will show that from the beginning of time in most cultures land ownership was considered the main measurement of wealth. Of course, on top of that livestock and crops played an important part as well. But people always need a place to live. And in areas such as ours when land is scarce it is hard to imagine that property values will stay depressed for too long. I know there is a buzz right now about "the end of home ownership being a pathway to wealth" about the end of the American Dream. Well, I don't believe it for a minute. There is a reason why property is called real estate. It is the only investment that has historically apreciated in value and that you can live in, grow food, raise animals and in many other ways meet some of life's basic needs.

Now I don't believe home ownership is for everyone. For many individuals, at certain times, renting makes more sense. There are many factors to consider when making a decision as big as buying a home. I think it remains the American Dream, and the dream of most people living on our beautiful blue planet. There is something special about having a spot that you can call your own . I can't imagine that this special relationship between the human being and the land he holds stewardship to will ever end.

No Dip in Home Sales in Berkeley

It was all over the news that nationally home sales took a major dive in July when compared to the prior month. I see two main reasons for that dive. The first is that seasonally, at least in the East Bay, sales take a dip. It happens every year. We have basically two home buying/selling seasons, Spring and Fall. July is typically slow and August even slower, much like December and January. The second and larger reason for this years' dip is that the government sponsored incentive ended June 30th. All buyers who wanted to receive this stimulus money or who were motivated to buy because of this had to close their transaction by June 30th. Well this meant that many buyers were motivated to take the plunge sooner than they would have if their were no stimulus. The second is that escrows that normally would have closed in July were pressured to close early. This should have been anticipated by the experts. It surprises me that so many economists were surprised at this data.
Now that I've said these things, the reality for Berkeley, California, indeed most of the East Bay, is quite different from other parts of our nation. I decided to take a look at the stats myself and compared June 2010 and July 2010 and this is what I found. In June 66 listings sold. In July the number was 65, hardly a significant drop. These numbers indicate that at least for the time being Berkeley continues to be a strong market for those who want to buy or sell a home.

In Albany the scene is pretty much the same. The numbers are smaller, 12 sold in June, 10 sold in July, so statistically there is not a lot of significance.

Oakland continues the theme: 390 homes sold in June vs 387 homes sold in July. Less than a 1% change.

We can look at other data such as median home price, days on market and new listings to get a better understanding of the market dynamics in the East Bay. East Bay Neighbor just learned of a couple of interesting events that are happening in Berkeley over the next few weeks. The first is on July 4th. the West Berkeley Neighborhood Associations are hosting a block party! Its on Chaucer Street between San Pablo and Curtis from 2-4. There will be a pot luck, barbeque, Green Fairy Farm animals, Yeast bay Brewery Home brew, Carole's lemons, white elephant stuff, home made crafts, back yard produce, live music with the Scottish Fiddler Society and more. this is a great opportunity to learn a alot about Berkeley's Left Bank Neighborhood by meeting neighbors and participating in the local get-to-gether

If you are interested in Urban farming, the Magic Gardens Nursery is hosting a kind of get to know chickens weekend on July 17 and 18. There will be demonstrations by Montclaire's 4-H club including showmanship techniques, as well as models of new types of chicken coops and cabanas. The Urban farm movement is growing and more and more folks want to raise their own chickens. If this appeals to you this is a great opportunity for learning, as well as networking with others of similar interest.

North Oakland is starting a new farmers market on Saturdays from 9-2 right behind 5715 Market Street. this is a sign of things to come in this up and coming neighborhood!

Look at the big picture!

If you are planning on buying or selling a home in Oakland within the next few months you should be aware of market activitiy. this chart shows that in the city as a whole prices have climbed 122% from May 09 to May 2010! That's a huge increase. From these stat it appears that the housing market hit bottom in Oakland about a year ago. During the same time period 17% fewer homes have sold. Keep in mind that these stats are for the City as a whole. Real Estate activity fluctuates greatly in different neighborhoods and zipcodes. these stats are painted with a very wide brush.

The Lorin District of South Berkeley T-PARTY!

This is a great example of "HOW BERKELEY CAN YOU BE?" and another reason why so many people want buy a home in this vibrant city of Berkeley, California.
We've all heard about the Tea Party movement that has become a very load voice for ultra conservative politics. Well Some knitters in South Berkeley formed a T-Party of their own. Gertrude Stein once said "There is no there in Oakland." Well, it seems they took that saying to heart. Now Berkeley boasts is very own (not a tea cosey) but a T cosey for the first letter of the THERE sign that greets folks traveling down MLK near Adeline as they leave Berkeley and enter Oakland. When you come the other way (leaving Oakland and entering Berkeley) you are greeted with a HERE sign. Well it seems that the knitters wanted to equal things out. City of Berkeley wants it down. Oh, I just learned about a neighborhood yard sale in North Oakland, on Lowell Street between 57th and Arlington, Saturday June 5th. This is a neighborhood effort and an example of how this neighbrohood is transforming with residents coming together in the spirit of cooperation and productivity. come out and support them!

New Happenings in the Lorin District of South Berkeley 94702 and 94702

I went on brokers tour today and saw this new designer condo project ready for the market. Its located at 1520 and 1522 Fairview Street, just a few doors east of Sacramento Street. This project is another indication of how this neighborhood is transforming. I often write about this area because it is close to my heart. I live here and I do a lot of my business here. As I've mentioned in other blog posts, there are great neighborhood associations. WANA for example is hosting a meeting tonight to talk about and plan for emergency preparedness. They already found a contractor who wold give a large discount on installing motion sensitive gas shut off valves. But let me get to the point I was originally making. It was two years ago that the project, Harmon Gardens, on the 1400 block of Harmon Street went on the market. These were extremely well done 2 bedroom 2 bath condos that sold in the mid 500K's. A last one bedroom unit just sold there this past month. Today the four units on Fairview looked extremely attractive. Also, I was noticing that a group called Youth Spirit Artworks is beautifying the neighborhood. If you are planning on buying or selling a house in the Lorin District of South Berkeley (which is almost the same as zip code 94703) the charts below may prove useful:
The first chart shows a year's comparison of Median home prices. The second chart shows number of days on market and the third indicates the months supply of inventory. Typically as the numbers on charts 2 and 3 decrease the numbers on chart 1(sales price) should increase. This is basic suply and demand economics. From these charts you can easily see that the price trend is upwards. I expect that prices will level off a bit as interest rates increase, but consider the approximation to Ashby BART and the relative inexpensiveness of homes in this area and you may come to the same conclusion that I have, namely that prices will appreciate more rapidly in this area than in many others once the economy turns.

New Restaurant and Cafes Opening in Berkeley!

Berkeley continues to be a vibrant community. The fact that a bunch of new eateries opening or soon to open attests to that fact. The following article was taken from the SF Business Times and written by Sarah Duxbury can be read at their site as well. The link is at the bottom of ths post.

Restaurant tenants are feeding Berkeley’s retail real estate market.

A host of new restaurateurs have signed leases to open in different corners of the city, each seeing a different opportunity even as an economic recovery remains uncertain.

“In this marketplace, the one tenancy we are seeing expand is food service,” said John Gordon of Gordon Commercial Real Estate. Gordon is fielding several food service inquiries every day, he said.

Jennifer Millar, owner of Sweet Adeline’s Bakeshop, scored six months free rent to open the 75-seat Addie’s Pizza Pie in the former Spud’s Pizza in South Berkeley. Her partner on that project is Thomas Schnetz of Flora and Dona Tomas, both in Oakland. The restaurant, which will serve New York-style pizzas and egg custards, should open by late spring.

In August, Anja Voth will open a German bakery restaurant in the old Metro Lighting space on San Pablo Avenue in West Berkeley. She said it will recreate traditional North German recipes with local, seasonal ingredients, “pretty much like my grandmother used to make.” Voth said she had been seeking a space for nearly two years.

Amy Murray from Venus Restaurant has bought the vacant Downtown Restaurant, and plans to remodel and open an 80-plus-seat restaurant called Revival Bar and Kitchen by summer. It sought a bigger space because Venus, with just 44 seats, couldn’t keep up with demand. It will remain open once Revival arrives.

Christian Geideman will open the East Bay’s first “izakaya” restaurant — sort of a pub-tapas bar that specializes in grilled meats. Sometime around April the Japanese-trained chef will open his 50-seat restaurant in 1,800 square feet custom built by Zen master and carpenter Paul Driscoe.

“This is decidedly not sushi,” said Patrick Kennedy of Panoramic Interests, and his landlord. “Basically, this is Japanese food for carnivores.”

Gordo Taqueria has signed a lease to open its fifth Bay Area location on Telegraph; Pinkberry will move in next door.

These new deals build on the success of recent entrants.

Gather opened in the David Brower Center less than two months ago and has been an instant success. A 28-seat prix-fixe fine dining restaurant called eVe opened on University Avenue in December.

“It seems like the energy’s there. You hear about smaller restaurateurs, newbies and folks with one or two restaurants, out poking around,” said Steve Smith, a broker with Norheim and Yost. “It may be that with the turn in the market and in the process of bottoming out, there are opportunities for them to seize.”
